SHIPPING CONDITIONS

Shipping is free of charge for orders whose net invoice value exceeds the following amounts, by zone:

  • Spain (mainland): €350
  • Andorra + Balearic Islands: €500 
  • Canary Islands (CFR Tenerife and Las Palmas): €950 
  • Ceuta and Melilla: €950 
  • Portugal: €800 


If the free-shipping threshold is not reached, the order may be shipped with the following charges added to the invoice:

  • Spain (mainland): €16 
  • Andorra + Balearic Islands: €40 
  • Canary Islands, Ceuta and Melilla: carriage forward 
  • Portugal: €45

PRODUCT RETURNS

  • Joma must AUTHORISE the return of the goods by assigning an RMA number once approved. This RMA number must be clearly visible on the returned goods.
  • No debit notes will be accepted for returned or defective goods. Credit notes will always be issued by Joma.
  • Discontinued and/or customised products cannot be returned.

RETURNS FOR REASONS ATTRIBUTABLE TO THE CUSTOMER

Only returns of products in perfect condition will be credited. Two options will be offered, taking into account handling, inspection and repackaging costs, etc.:

  1. ​Credit (in euros) of 80% of the purchase price (return without replacement).
  2. ​Valuation (in euros) of 90% of the purchase price, with an order for replacement goods (return with replacement). The cost of shipping the goods back to Joma will always be borne by the customer.

RETURNS FOR REASONS ATTRIBUTABLE TO JOMA

  • Joma will collect and replace the goods.
  • Returns attributable to Joma will only be accepted for invoiced products within 30 calendar days of dispatch of the goods.

TRANSPORT CLAIMS

The customer must check that the goods are in perfect condition before signing the delivery note. We have 24 hours to forward any claim to the carrier, and it must be accompanied by photographs.


STANDARD TERMS AND CONDITIONS OF SALE


  1. The customer expressly waives its own standard terms and conditions, even if these were drawn up after these standard terms and conditions of sale. To be valid, any derogation must be expressly agreed in writing and in advance.
  2. Our invoices are payable within 30 calendar days, unless another payment term is stated on the invoice or the order. In the event of non-payment by the due date, Jose María Gallastegui y Cía., S.A. reserves the right to claim fixed interest of 10% of the outstanding amount. Jose María Gallastegui y Cía., S.A. shall be entitled to suspend the provision of any services without prior notice in the event of late payment.
  3. If a payment remains outstanding for more than sixty (60) days after the due date, Jose María Gallastegui y Cía., S.A. reserves the right to use the services of a debt collection agency. All legal costs shall be borne by the customer.
  4. Some countries apply withholding taxes on the amount of invoices, in accordance with their domestic legislation. Any withholding tax shall be paid by the customer to the tax authorities. Under no circumstances can Jose María Gallastegui y Cía., S.A. bear costs arising from the legislation of a country. Consequently, the invoice amount is due to Jose María Gallastegui y Cía., S.A. in full and does not include any costs related to the legislation of the country in which the customer is located.
  5. Jose María Gallastegui y Cía., S.A. undertakes to use its best efforts to provide the services within the agreed time. However, none of its obligations may be regarded as an obligation of result. Under no circumstances may Jose María Gallastegui y Cía., S.A. be required by the customer to appear as a third party in connection with a claim for damages brought against the customer by an end consumer.
  6. To be admissible, any claim must be notified to Jose María Gallastegui y Cía., S.A. by registered letter sent to its registered office within 8 days of delivery of the goods or performance of the services.
  7. All information contained in this catalogue is provided for information purposes only and is not contractual. Jose María Gallastegui y Cía., S.A. reserves the right to make changes and improvements to its products.
  8. All contractual relationships shall be governed exclusively by Spanish law.

The data will be kept for as long as necessary to fulfil the purpose for which they were collected (for the duration of the business relationship) and to comply with the legal obligations arising from the processing. The purpose of the processing is the performance of a business relationship, and the legal basis for such processing, in accordance with Article 6.1.b GDPR, is the performance of a contract. You may exercise your rights of access, rectification, erasure, restriction of processing, portability, objection and not to be subject to automated individual decision-making by writing to joma@joma.es.
